NEW: More states propose scheduling Salvia divinorum Options

[This post deals with regulations in the United States]

To the best of my knowledge, there are only 18 states left which have not passed legislation regulating Salvia divinorum and/or salvinorin A (I haven't completed an exhaustive review of the law, so it's possible the number might be a little smaller). In two of those states, it has been banned by executive action of a state regulatory body. Of the 34 states which have regulated the plant, 3 only restrict the plant with regards to minors and allow adults to possess it legally. So basically, there are 19 states in which adults are still free to use the drug.

Of those 19 states, 5 are considering bills to regulate the plant in the current legislative session. One state, Arizona, is only seeking to regulate distribution to minors. But if you live in one of the other four states, please consider contacting your legislative representatives and urge them to vote no.

Montana: House Bill 140 would add S. divinorum and salvinorin A to Schedule I in the state. As of 14 January 2013, the bill is pending House Judiciary Committee review.

New York: Senate Bill 1454 would prohibit any sale or distribution of S. divinorum. It does not regulate salvinorin A, nor does it prohibit possession or cultivation (though it would prohibit anyone from selling cuttings to people in New York). On 9 January 2013, the bill was referred to Consumer Protection prior to filing. It is identical with Assembly Bill 1033, which was referred to the Assembly Codes Committee on 9 January 2013.

Texas: House Bill 124, filed 12 November 2012, would add S. divinorum and salvinorin A to Penalty Group 3 of the state's Controlled Substances Act. It also includes ``any compound'' from the plant... so I guess chlorophyll would be included in Penalty Group 3 as well if the bill passes?

Rhode Island: House Bill 5063 would add S. divinorum and salvinorin A to Schedule I of the state's Controlled Substances Act. It was introduced 10 January 2013 and referred to the House Judiciary.
