Hello all. I have a question regarding state laws and plants that are not federally scheduled (i.e. caapi, Anandanthera spp., ac. conf., etc.). I have been looking through the FAQ and going through a lot of threads trying to find an answer so that I wouldn't be starting a duplicate topic, and, well because I end up going on tangents and learning about other things when I browse through the threads. I am in a place (mindset) right now where I think that it would be beneficial to cleanse myself of the toxins accumulated by years of booze and adderall/vyvanse use. I also feel like I am being called by the vine. It sounds so stupid, but it is like something is offering to give me a hand, but I don't know how to pursue it. I feel that I can learn from the Madre and move into the next phase of my life. But I am also wary that I don't have the capability to meet her. I am very interested in a few different plant teachers in addition to the vine, and I am also very hesitant to order them due to conflicting DEA info./erowid info./my state's info. It's a shame, because I've been following a lot of the gardening threads and think that it's an excellent idea. I know that with more work comes a greater reward with food, so why would it be different with insight, right? Anyway, my question is if things like cebil seeds, pedro, or caapi would land me in trouble if I order them online? Or, is it kind of a crapshoot? It seems as though the stricter of the two (state v. fed) prevails--is that correct? If I decide to order something do I just e-mail wherever I decide to order from to see if they take cash or Western Union or something? It's crazy, I am almost more comfortable obtaining things that have a definite "yes" or "no" than these grey area plants and herbs. I was contemplating buying some jurema over the summer, but I didn't know how to pay for it, nor did I have the knowledge of how to work with it--and now that avenue seems to be monitored. I am not asking for sources--please do not think that. I am aware of a few places, and have been biding my time for a few months while I gather information. So, I don't need any sources. I'm looking for advice on how to be safe. I just don't want to order a few decorative cacti, or some exotic seeds, only to have Johnny Law waiting for me when I get home from work.

In the US, the way the Controlled Substance Act is worded is such that any plant or material that you know to contain a scheduled substance is illegal. That means that any mescaline-containing cacti, dmt-containing plants, etc. that you have/order are technically illegal for you to possess. That said, the odds of them coming after you for ordering or possessing obscure plants that contain a scheduled substance are pretty low. Fyi, caapi (and harmala alkaloids) are completely legal in the US. There are many vendors openly selling plants that are illegal if you know what's in them, but it's not worth the time or effort for LEO to go after small rare/exotic plant nurseries, let alone small-scale buyers. I can't really help with the question of how legal any of these things may or may not be. I thought MHRB was legal when I ordered it, apparently I was wrong. I'm almost positive Lye is still legal, but after ordering some I found out it's being "watched". I think Caapi is legal to order right now, I bought a live plant recently without any problems. But who knows that could be wrong as well. But regardless of all that, there are a couple of things you can do to make it safer. Pay with a gift card, registered to a false name, and use a disposable email address to make your account with the site you order from. Also if possible have it delivered to an address other than your own, someplace that if the door actually DID get kicked in, nothing would be found. If you can, grow the plants somewhere other than on your own property too. Realistically, if a crackdown on these plants were to happen tomorrow, it would probably target the distributors rather than their customers, like what happened with MHRB. It would just be too much effort and expense to track down every head who ordered some seeds, and try to figure out where they all ended up. If possible it's best to buy in person. It's very rare, but sometimes it works out. I bought my p. viridis plants off of an online classified ads site. The important thing is not to buy a ton, as the quantity may get you flagged were something to happen. As nice as it would be to stock up for the long run, it may not be a good idea, but I have never heard of anyone having issues for buying for personal use. And BTW, lye is still sold at a certain blueish hardware store. Pay cash, and no tracking! I always pay cash. Be an adult only when necessary.
