ps this does not affect the international community for sponsorship, however we politely ask that US citizens no longer email us asking for sponsorship or questions in regards to the treatment methods or medicines involved- our hands are tied.

When will this madness end?

An un-win-able war which does way more harm than good... over 5 decades this debacle lives on and on, despite never being put to a popular vote. The US can't even afford to feed the poor, and yet they have money for a war on nature? The arrogance and stupidity dumbfound me.

To go to other lands and tell them which fungi and herbs they can or can not pick from their own soil... to force people to abandon millennia long spiritual practices at gunpoint... to put people behind bars for having the audacity to think they own their own body.

Aaaarrrrggh!

Now just expressing an intent to engage in legal behavior overseas is a crime? Fucking Dante's Inferno is too good for these people.

Don't be sorry for the rant at all. At the occupy boston rally they have constructed a 'soap box' that anyone can get up on and rant. I would love to have you up on that soap box!

It is so frustrating that people don't seem to realize that a war on drugs is literally a war on freedom. I could get behind all the arguments against selling to minors and driving under the influence, but when it comes to personal safe consumption? Back the fuck up off me. This is my body. It is my temple and I'll use it to worship the gods in what ever manner I see fit. I am not hurting anyone including myself. Therefore no one has the right to tell me no.

Joedirt, i think you have forgotten something. There is no place for a free mind in todays society. Any attempts to break free from conditioning from parents, governments, religions, etc, will be met with fierce resistence. Your parents will make you feel guilty by asking you if you love them or not, the governments will set the police on you, and the religions will call you an evil sinner.

This is really, really disgusting. But so far it has only been passed by the House Judiciary Committee. It would still have to be passed by the full House, by the Senate, and signed by the President before it becomes law.

Here’s a link to the bill:

H.R. 313 - Drug Trafficking Safe Harbor Elimination Act of 2011

Here’s the main section of the Bill:

Whoever, within the United States, conspires with one or more persons, or aids or abets one or more persons, regardless of where such other persons are located, to engage in conduct at any place outside the United States that would constitute a violation of this title if committed within the United States, shall be subject to the same penalties that would apply to such conduct if it were to occur within the United States.

So what are some of the consequences? If, from within the US, you make plans to attend an ayahuasca retreat in Peru, you could be charged as a co-conspirator under the CSA. Any US citizen who makes plans in the US to go to another country to consume substances that are illegal under the CSA would be considered a co-conspirator in drug trafficking.

As I read it, this law is not limited to US citizens, but includes anyone who is conducting such activities within the US. So a Peruvian citizen who, during a visit to the US, calls home and makes arrangements to participate in an ayahuasca ceremony, could be arrested and charged with a violation of the CSA.

There’s a Huffington Post article that discusses this, and it suggests that US citizens abroad planning activities illegal under the CSA could be charged. This isn’t how I read the Bill. As I read it, the planning must occur “within the United States”.

So if you go to Peru and, while in Peru, make arrangements to attend an ayahuasca ceremony, you wouldn’t be in violation. Regardless, it’s a Bill that seeks to extend the laws of the US worldwide.

Let’s hope that enough of our legislators have the common sense to ensure that it doesn’t pass.

Let’s say you’re on vacation in New York, and while there you decide to order some cannabis from the Netherlands and have it shipped to your home in Europe. Regardless of the legality of these activities in Europe, you would be considered by the US DEA to be a co-conspirator in drug trafficking and could be charged!

Yeah, this is basically unenforceable drug warrior wankery forwarded by an unelectable GOP in comedic disarray. I wouldn't get too upset about it. In principle it's abominable, sure, but from a legislative and legal standpoint it is an absolute joke.

Unless a US citizen were to personally submit a notarised missive to the DOJ confessing their evil drug taking activities whilst abroad, there is very little chance of charges being pressed, much less holding up in court.
Sometimes I believe that this less material life is our truer life, and that our vain presence on the terraqueous globe is itself the secondary or merely virtual phenomenon.

I don’t think the Bill addresses activities of US citizens abroad, regardless of whether they “confess” such activities. This is where I think the Huffington Post article got it wrong.

What the Bill does address is, from within the US, planning or conspiring to engage in activities outside of the US that are illegal in the US.

So, with respect to US citizens, attending an ayahuasca retreat in Peru is not illegal, but making arrangements from within the US to attend the retreat would be illegal.

Either way, it’s absolute nonsense.

Ah yes, I stand corrected. It seems to specifically target drug conspiracy on US soil. Which seems to make it all the more tenuous and "thought-crime" like.

Legally this strikes me as similar to the Cuba embargo - Americans wishing to go there can simply stop over in a third country (Canada, Bermuda, Mexico, etc.) and travel legally from there. Similarly, any ayahuasca trips or pot holidays could be planned and organised from third countries if need be.

So this is basically the beginning to government telling you what you can and cant do even when it exists as simple conceptual discussion of events that take place off US soil..as a US citizen you are now property of the USA. Watch out, even discussion of activities taking place in another country where they are illegal can get you locked up..how can you NOT be paranoid living in that?

Often I have said that I feel cananda is just a bad as the USA..but I no longer believe this to be true..I thought it was bad here..but not THAT bad...I mean..that is freaking BAD..If you live in the USA you basically live in a country that now dictates to you what you can think while on US soil..

Well I meant that I feel europeans have much more freedom than US people when it comes to these laws. Especially when it comes to your own country watching your ass in OTHER countries. That's just crazy and messed up.

Americans used to be so against of the limiting matters in soviet union, and now two decades later, they're doing it in their country. Limiting their people, now even in other countries.

You’ve got it partly wrong. The US isn’t concerned with US citizens in foreign countries planning to take and/or partaking of substances in those countries, regardless of legality. At least this Bill doesn’t go that far. That conclusion is an error made in the Huffington Post article.

The Bill says that anyone in the US, citizen or not, can be charged with a crime if they make plans (i.e. engage in conspiracy) to engage in activities in foreign countries that would violate the CSA in the US.

So this Bill addresses activities within the US only – namely drug trafficking conspiracy. (And yes, the Bill considers emailing Chimbre and discussing obtaining the sacrament of ayahuasca within the email to be engaging in a drug trafficking conspiracy.)


edit: If you are in the US and email a Chimbre representative who is also in the US and you both discuss obtaining ayahuasca in Peru, then both of you would be guilty of conspiracy under this Bill.
