Certainly Snozz, it is a shame but true.
I can't seem to find anymore info on sentencing for these types of situations, if anyone can dig anything else up it would be appreciated.

SWIMfriend wrote:Probably like most people your "knowledge" of the danger of meth labs comes from news reports. Might it be that such knowledge is just as dishonestly presented as news reports about "DMT labs?" i cooked more than my share of go-fast in the late 90's, and this is one instance where the reports are pretty much accurate... cooking meth is INSANELY dangerous... once, as i was droppping the lithium strips into solvent, a drip of sweat fell from my forehead & caused a flash fire... i was hairless for 3 months... one drop of h20 in the mix when you add anhydrous and it's a similar situation... hell, just stripping the lithium from the batteries can lead to nasty, nasty chemical burns... it is truly a nasty, dangerous process... & a nasty, dangerous result, even if you do everything right... as for the comparisons between dmt/meth labs, well, it is a bit of a stretch, and not a bit of a stretch... the first step of an old-school cook is extracting the pseudo from the press-tabs they are sold in... a process that, having performed them both, is very similar to the extraction of DMT from MHRB... & the new, shake & bake method... if i walked in on a guy doing it, i'd have to ask... spinning a set the stars through which the tattered tales of axis roll about the waxen wind of never set to motion in the unbecoming round about the reason hardly matters nor the wise through which the stars were set in spin...

These kids were quite lucky in my opinion, I'm sure age and minimal previous record played a role in that decision as well. I only meant to emphasize that even though no jail term gets involved, a permanent stigma is attached to you--in a sense. worse that if you had committed murder: you are stigmatized as a felon, to which is ADDED the particular stigmata of being a drug felon.

It is a terrible thing SWIMf, I am just glad for those kids, that they don't have to spend the next 5-10 in a prison cell, then deal with the stigma of being a felon/parolee.
This statement is in no way to downplay the disorder of drug laws, which are obscene.

Maybe they start similar charges against those operating an art studio, or homemade soap manufacture, in a home with children as well... "Infinite Diversity, in Infinite Combinations."

this makes ME MAAAD!!!!!! ARGGG!!!! How freakin stupid!!!! Child endangerment?! The F is that? Probably ought to get child endangerment charges for driving kids around in cars. God forbid anyone want to alter their consciousness with anything but our lovely precious poison, alcohol! Rant complete. Be an adult only when necessary.

There is danger all around a house for toddlers to discover even without 'kitchen chemistry'. The police love to use the press to over sensationalize everything they do in the press to prove that they are earning their keep. So my friends, don't be so shocked when they do it! And by the way, they are paid to file charges and to bring evidence to the prosecuttorial authorities of a given jursidiction. It is an adversarial system by design. It is not their obligation to provide evidence to exonerate those who they have charged. They will take every innocent word that you say and twist it around to cause you the greatest harm. Their interest is not really to bring justice to society in my opinion. They server and protect, but it is not you that they serve and protect. It is their employer that they serve and protect. Frusciante wrote:That is a good question 3rdI. I feel like this depends highly on the part of the country it happens in. The thing about this article which strikes me as odd is there is no mention of distribution, what gave the authorities the right to warrant a search? How did they become aware of this "lab"? The photos give no inclination to the production of large quantities, just a small setup of jars. This one is sort of boggling my mind, they must have been keeping a close eye on these guys but why? This was exactly the first thing that came to my mind. There is also no mention of any other drugs being found. The whole thing just seems weird to me. No big mystery, most of the time it's an angry ex wife or GF that calls in the cops. Possibly trying to get full custody. "Officer, my ex husband is making drugs in the house where my daughter is staying and I'm scared for her safety!". Boom done deal, here's your warrant go get those scumbags. The way the law works in the US, it doesn't take much at all for police to get a warrant (or even conviction) for drug-related offenses. Theoretically, afaik, to get and execute a warrant, all they'd need is information from a credible source that there is drug-related activity taking place in a certain location. Hell, there are cases of people going to jail for long stretches for distribution of LSD without a single dose ever being produced by the prosecution. It sure looks as if one of those photos is of a big assed jar of spice being lifted out of a cooler. If so (and I doubt that was lye they were keeping chilled), there's your answer. If these guys are extracting while they already have some humongous supply on hand, what is the most obvious assumption?
Regardless, call me a prude if you like, but I actually do think that performing extractions using solvents and lye in a home with small children is dangerously selfish and irresponsible.

I have to agree that you better keep things that are dangerous for children locked away and out of their reach no matter what the purpose of the items. It is totally irresponsible and negligent to leave harmful things within reach of small children. Anyone who has lived with a two year old finds out that they will get into almost anything by moving chairs ans stools to get up high and explore. We lived in a house with two stories speaking of really dangerous situations for small children. I had baby gates, locks, hinges with door closing springs, and even more gadgets around my house to keep the kids out of stuff and places that they should not get into.
