Not exactly, I think the charges were dropped; the associated government agencies did not want the BBB case tried in court for some reason, even though I think it was pretty clear he was guilty as charged. I think some speculated that if they pressed through with the case (it seemed like a pretty solid case from my amateur reading), the law (Controlled Substances Act) could have been called into question during appeals. It'll be interesting to see what happens for this case.

Over a million actually... he never got it back...

As much as I am against the feds, BBear had it comin... He should have KNOWN better then to HOST a web forum, linked directly on his store site, that talked about preparation teks, consumption and experiences from all his illegal plants.

There were MANY sites (Nexus, Aya.com and lots others) that already had a STRONG foothold in the preparation information sector. Hosting the forum himself and blatantly violating FDA rules regarding how these plants can/can't be consumed was nothing short of a selfish endeavor meant to increase his marketability and profits.

I even "had it out" with guy's Dad on the Shroomery... he even rage-quit after I told him off when he denied doing NOTHING wrong by opening those forums. Even in defeat he couldn't admit his mistake.... The jerk even accused US, the END USERS, for popularizing the plants and bringing him heat!!!

So because your customers like your product and promote your business they are at fault when YOU decide to break the law?

^ sadly, I agree. BBB did have it comming and they way they marketed some things always seemed sketch to me which is why I never ordered from them. I dont think they deserve what happened though at all..but they could have been quite a bit smarter about how they appraoched the whole thing and potentially avoided that mess.

Some vendors have now stopped shipping to canada just like many vendors stopped carrying mimosa altogether after the whole BBB thing..once BBB won in court though it set a precedent and other vendors began to carry it again. Lets hope that is what happens here in canada with this case.

Ive asked about this before but never got a response. Has anyone heard what happens in these cases? If you are going to be charged with the amount of mhrb you have as being the amount of dmt you have, then youre better of extracting it all rather than doing a little at a time.

my guess is that it would not hold up in court..I mean it is just rediculous. Imagine if they found you with 7g of cannabis and tried to charge you with possession of 7g of THC...I would think it would be thrown out of court.

my guess is that it would not hold up in court..I mean it is just rediculous. Imagine if they found you with 7g of cannabis and tried to charge you with possession of 7g of THC...I would think it would be thrown out of court.

Not to pick hairs, but BBB's case did not go to court and there was no precedent set. He was arrested on state charges, but these were dropped for unclear reasons. The only large-scale DMT-related seizure and arrest I'm aware of is Alan Shoemaker, who was arrested after having shipped several hundred pounds of chacruna leaves to USA. He apparently pissed off DEA officials in South America due to his exposure of unethical drug enforcement activities there (which resulted in the shooting down of a plane carrying American missionaries), and it has been speculated that government officials went after him based on this.

What kind of unethical drug enforcement activities did he expose? Is he still in jail or got out? Was he convicted in trial?

What did a plane of american missionairies have to do with the whle thing?

It is just the powdered root bark that is being seized in Canada at the moment, according to some who have had largish quantities (40kgs) seized. The reasoning being that it is already partially processed.

Sister was reading through some Canadian law not to long ago, and stumbled on an ambiguous piece of legislation, that declared that importing substances that could be easily converted to a scheduled drug, could be procescuted as though the scheduled drug was being imported. At the time sister read it, she thought they were referring to things like 1,4 butandiol or GHB. But if they were able to prove intent to sell , it is possible that this law is being invoked. Sister will see if she can find it again and post the actual law.

Possession for the purpose is another bitch law in Canada as it puts the onus to prove innocence on the accused, rather than leaving the onus to prove guilt with the crown.

One last thing to consider, is that they recently passed Bill C-30 in Canada. This gives law enforcement access to all internet and phone records of anyone they happen to be investigating without the need for any judicial oversight - no warrant required anymore. This should make anyone who has purchased from this individual very nervous, as the RCMP will have as complete a customer list as his email or paypal keeps.

So all it will have taken is one drug reference in any email correspondence with one of his customers (perhaps about yeild ..) and the they would have their case against him. The Harper government also passed a bunch of legislation mandating tough minimum sentencing for trafficing charges. Canada is no longer the haven it once was. Harper is changing everything and is now on a prison building spree that goes hand in hand with his tough on crime bill.

I dunno man. I knew a guy who got charged with having a few grams of LSD because that was what his strip weighed. Probably had a shitty lawyer.

From my memory, he helped investigate (published photos) of an incident where a US DEA-sponsored plane shot down a suspected cocaine-carrying plane in SA; it turned out the plane was carrying 3 American missionaries. This was just one example of stupid overzealous drug enforcement activity ending in ruining the lives of common people. Later a package he sent from SA to USA was found by US Customs with a large amount of chacruna (I think 200 pounds, google is not working for me). It was speculated that they were already pissed off at him for his activist work in SA and for this reason he was arrested, but he fled while on bail to South America, where he's currently involved in the ayahuasca business in Iquitos. Seems the Peruvian government won't extradite him back to US (I think countries don't usually extradite when the "offense" is not considered a crime in both countries, and of course chacruna is not considered a controlled substance in Peru). This is from my memory, a google search may clear this up endlessness.

Very interesting thread.. sounds like they are really starting to crack down on mimosa over there.. I hope the same does not happen for our beloved and divine Acacias over here in Aus
