Okay. Lets everyone list the FACTS as we know them, dispel whatever myths are most certainly arising and most importantly stop worrying. This is a scare tactic and because it has worked in other countries it will work here if we let it.

This is about one thing, K2.

My understanding is that all the other named plants on the seize list were 'misspelled'.



Are there any minds at this site that can shed some light on the legal aspect of this bust?

Yes. It was about K2. The other herbs were added to the list just to make the case appear stronger than it is.

K2 is actually not illegal in the US at a federal level. And it has yet to be signed into law in Kansas.

As I understand it, the only person arrested was the owner of BBB, not the K2 manufacturers.

I think they could not arrest anyone based on K2 because it was not illegal at the time of the raid. The other herbs (mimosa, cacti, etc.) are in a gray area, and could be legally viewed as “containers of illicit substances”. Although DMT, mescaline, LSA and bufotenine are the centerpieces of many North, Central, and South American religions, and therefore cannot be illegal. The laws that outlaw the religious sacraments DMT, mescaline, LSA and bufotenine are themselves unconstitutional in the US. They essentially outlaw entheogen based religions and are not valid laws. This has been proven before in court causing peyote to be legalized for the NAC. However those laws are racist, and also unconstitutional because they only allow members of the Native American Church to use Peyote. They need to be amended to allow all US citizens the right to legally practice Peyotism without attending the NAC. Shamanism as a whole needs to be legalized. American shamanism utilizes DMT, mescaline, bufotenine, and LSA primarily. Because of that, these compounds cannot be banned. DMT, mescaline, bufotenine, and LSA are critical components of Native American shamanism and there is a ton of evidence that supports that.

As an American, I have the right to religious freedom. I have the right to practice shamanism. That means I have the right to use plants like chacruna that contain DMT in order to practice shamanism. I also have the right to use cacti, morning glories, yopo, etc. These are critical parts of American shamanism and cannot be illegal.

This is a huge attack point, one that I think can be leveraged to counter sue the FDA and impose further restrictions on the FDA.

By supplying chacruna, BBB is supporting shamanism. By seizing the chacruna, the FDA is attacking the religious freedom of the US citizens and is in violation of the US constitution.

FACTS (as objective as I can):

1) I just want to add that here in Mexico, the federal and military forces under the command of Felipe Calderon are under active war against narcs and drug cartels. These drug cartels are specifically in the business of Marijuana, Cocaine, Methamphetamines and Heroin.

2) The only entheogenic web shop with facilities in Mexico is "salviadivinorum dot com dot mx". They sell Mimosa Hostilis.
They also sell Datura, San Pedro, Yopo and Kratom. They deliver real fast.

2) The shamans in South and Central Mexico nowadays practice their religion with Mushrooms, Peyote, LSA seeds and now even with Ayahuasca, The military knows this and they are left alone. Why? Because it is ancestral culture and it should be respected. The only time lapse the mexican shamans were bothered by the police was when they got all the attention in the old hippie days. Maria Sabina was arrested under the charges of "dealing marijuana" and then freed because that was completely false.

4) There is no law protecting mexican shamanism, like in United States or Brazil, but still one can go to a shamanic practice in Palenque or San Luis Potosi or Huautla de Jimenez without the fear of being arrested by the police. One may be arrested if caught collecting or consuming fresh wild mushrooms or stealing peyote roots.

5) These mexican shamanic practices are slowly but surely turning into a business. Local indigenous people are seeing the benefits of selling their services to foreign visitors ( European and American mostly) for some Euros/Dollars. The shamanic practices is slowly losing its essence in my country as days pass by.

6) Some mexicans and some foreigners are stealing Peyote from San Luis Potosi. In this case, a German and a Canadian were involved.
They had 900 peyote heads in a storehouse and were planning to distribute it to unidentified sources.




We need to do something about all this before it all goes to hell. I think we are still in time.
Honestly, Legalization is the only way. I'm so sad about the things that are happening. I'll post more information later.

just on a little note, there IS a law in Brazil regarding the use of ayahuasca. It is quite specific about certain things, for example it is not allowed to sell ayahuasca, etc.

There is nothing mentioned about Mimosa in any law, and it is very commonly available in the northeast of the country, where its originally from. DMT is still illegal, though, so extracting for example is obviously illegal.
